Evolutix cares and processes data in accordance with national and international laws.

We would like to inform you about the personal data collected about you by company(ies) that are part of the Evolutix (“Evolutix”) group of companies , for what purposes, and your rights in this regard.

These Privacy Policies may be supplemented by local/additional policies.

These Policies are also available in local languages (where applicable) on the Evolutix website of the country where data processing occurs.

What does this privacy policy cover?

This privacy policy provides information about the processing of your personal data when using services and/or contracting services and/or purchasing products from or on behalf of a company or companies that are part of the Evolutix group of companies (or simply “us”), such as:

a) customer, understood as the legal entity and/or individual, who contracts services and/or products from Evolutix or through it, sporadically or regularly, with or without commercial backing;

b) visitor to an Evolutix website (“Site” or “Evolutix Site” );

c) user of an Evolutix application or other applications integrated and/or participating in Evolutix (“Evolutix Applications”).

If you choose to, a personal profile will be created for you to use and navigate through these Evolutix services (through “Single Sign-On” or “SSO”).

In addition to this policy, other supplementary policies may contain additional information to reflect local practices and applicable legal requirements, containing additional contact details regarding the processing of personal data by Evolutix.

This Privacy Policy explains which personal data is processed, for what purposes, how long we keep personal data, how to access and update your personal data, the options you have regarding your personal data, and where to find additional information.

In addition to the details indicated, Evolutix informs that it does not intentionally collect personal data from individuals under 14 years of age.

If you are under 14 years old, do not send us your personal data (e.g., your name, address, and email). If you wish to ask a question or use the Evolutix website and/or Evolutix application or in any other case, when prompted to submit your personal data, ask your parents and/or guardians to do so on your behalf.

Your local Privacy Statement may contain more detailed information about the age limit for using certain Evolutix services.

What personal data is processed by EVOLUTIX?

Information Collection.

Evolutix collects and/or may collect information and data, including personal data about you, as a customer of Evolutix, user of Evolutix applications and/or visitor to an Evolutix website.

This information and/or data may include:

a) The information you provide to us – when creating an Evolutix account profile, through contracting services and/or products from it, we will request your name, email address, and gender (so that we can treat you properly, but you do not need to provide this information to us), personal documents, including the General Registry Number (RG) and the Individual Taxpayer Registry (CPF), your contact preferences and information necessary to answer any security questions, as well as bank details, corporate documents (if applicable), user and/or customer domicile data from Evolutix, as well as communication preferences and cell phone number.

b) In the case of legal entities, in addition to the documents indicated in the previous item, we will also request the sending of the National Register of Legal Entities (CNPJ) Card, in addition to the last registered copy of the Contract or Social Statute, in addition to RADAR and other documents required by the Brazilian Federal Revenue Service for export and/or import acts.

c) Information we obtain through your use of Evolutix services – we will also collect information about how and where you use or purchase Evolutix services and products. Such information may include electronic device information, IP addresses, log information, browser type and preferences, location information, online identifiers to enable “cookies” and similar technologies. Your purchase and/or hiring history includes data about (i) specific products you buy and/or hire, (ii) the total value of your purchases and/or hiring per transaction, (iii) who made and the time and place of the purchases you make, and (iv) the payment method you use, including payment methods performed.

Evolutix may, depending on the service and/or product purchased/hired, require new documents and data, which will be processed in accordance with this Privacy Policy.

Evolutix’s objectives in processing your data.

The personal data covered by this Privacy Policy is processed only:

a) with your explicit and unequivocal consent as the data subject and/or legal representative; or

 

b) when necessary to complete a transaction with you (such as payment information); or

 

c) when necessary for Evolutix to comply with a legal obligation.

In cases where processing is based on consent, you have the right to withdraw your consent at any time, provided that it is expressly indicated.

This will not affect the validity of the processing before the withdrawal of consent.

If you choose not to provide the information mentioned above for the purposes of using an Evolutix application, the only consequence is that this will affect your ability to fully interact with Evolutix, thus preventing, for example, any legal transaction to be concluded between you and/or your representative and Evolutix.

Evolutix processes your personal data for purposes of:

 

a) promoting the maintenance and promotion of contact and relationship with you;

b) promoting account management with Evolutix, i.e., enabling, in the face of a constant and profitable commercial relationship, that you may have differentiated conditions from the market;

c) customer service and development;

d) performance and analysis of market research and marketing strategies;

e) promotions and contests offered to Evolutix customers;

f) detection or prevention of fraud;

g) or for a secondary objective, when intrinsically related; for example, for storage or deletion).

 

Evolutix, therefore, aims with the processing of your data only to fulfill the legal transactions that are and will be concluded with you and/or with your representative.

Evolutix’s responsibility for the processing of collected data.

Depending on your location, Evolutix or a company contracted by it will be responsible for processing your personal data. The local area of your country specifies the local company responsible for processing your personal data, as already indicated in the Legislation.

Evolutix’s objective is to keep our information as accurate as possible. You, as the data subject, may access your personal data, request corrections or deletions of personal data (but only if they are no longer necessary for the legitimate business purpose, such as completing a retail transaction), and request that the processing of your personal data be restricted.

Evolutix implements new technologies and policies with the aim of protecting your privacy against unauthorized access and misuse.

Furthermore, Evolutix may use encryption for some of our services and apply an authentication and verification process for access to services, as well as regularly test, access, and evaluate the effectiveness of our security measures.

Use of data for marketing purposes.

If you have consented to receive such communications from Evolutix, you may receive offers personalized according to your preferences, as well as informative newsletters on subjects of your interest, based on your use of Evolutix services, your history of purchases and services hired, your participation in promotions, surveys, in the Evolutix loyalty program, and your use of the website, applications, and other digital channels of Evolutix, as well as other data you have provided to Evolutix.

Evolutix may send you updates and service notifications without your prior consent, only if you are an existing user of the Evolutix website and/or other services and/or products thereof, and such updates and/or notifications are necessary for the proper operation of Evolutix or other services you use.

You may receive relevant offers and communications through different Evolutix channels, and you can update your subscription preferences through the settings of your Single Sign-On account at any time, or use the unsubscribe functionality for various digital channels, provided that such actions are explicitly communicated to Evolutix.

Your right to data portability and clarification requests to Evolutix.

You have the right to receive personal data concerning you that you have provided to Evolutix in a structured, commonly used, and machine-readable format, and to transmit this data to a third party, if technically feasible and without imposing costs on Evolutix.

For this right to be effective, it is requested that you contact us through the contact details in the Privacy Policy and/or by email dpo@evolutix.com.br, indicating in the subject of the email the term “Evolutix.”

However, if you have any problems, doubts, or complaints about the processing of your personal data, please contact us through the contact details in the Privacy Policy and/or by email dpo@evolutix.com.br, indicating in the subject of the email the term “Evolutix,” to obtain additional information or to submit these requests.

Nevertheless, it should be noted that you also have the right to lodge a complaint with the data protection supervisory authority in the location responsible for Evolutix activities, by means of direct notification to the National Data Protection Authority (ANPD), located at Praça dos Três Poderes, in Brasília (DF), Palácio do Planalto, Anexo I, Ala B, Sala 101, email: anpd@anpd.gov.br.

Sharing and transfer of personal data to third parties.

Your personal data is processed exclusively for the above-mentioned purposes and will be shared only when strictly necessary for:

a) Other companies that are part of the Evolutix group of companies;

b) With your prior consent, third-party companies authorized in cooperation with Evolutix that may provide products and/or services to Evolutix website users or Evolutix software programs to perform and/or adapt measures by design to obtain a higher degree of effectiveness of their services and/or products;

c) Authorized service providers involved in mobile payments, as well as banking establishments and/or scoring consultancies;

d) authorized agents, licensees, service providers, and/or subproviders of Evolutix;

e) a competent public authority, government, regulatory or fiscal agency, where necessary to comply with the legal or regulatory obligation to which the relevant company(s) of Evolutix is/are subject, or as allowed by the applicable local law;

f) any person with whom Evolutix intends to transfer any of its rights and/or obligations.

Evolutix may also share your data with third parties if there is a court order to do so, and therefore cannot be held responsible for such acts.

In cases where personal data has been transferred to companies that are part of Evolutix and/or authorized third parties, located outside your country (including outside the European Economic Area), we take organizational, contractual, and legal measures to ensure that your personal data is processed exclusively for the purposes mentioned above and that adequate levels of protection have been implemented to safeguard your personal data.

These measures include Evolutix’s Binding Corporate Rules for transfers between Evolutix and the European Commission, approved transfer mechanisms for transfers to third parties in countries that have not been considered to have an adequate level of data protection, as well as any additional local legal requirements.

Except as provided in this Privacy Policy, we will not disclose any personal data without your permission, unless we are legally designated to do so, or if we believe that such action is necessary to protect and/or defend our rights, property, or personal protection, and the rights of our users/customers or other individuals.

Evolutix implements technologies and policies with the aim of protecting your privacy against unauthorized access and misuse.

In particular, Evolutix may use encryption for some of its services and apply an authentication and verification process for access to services, in order to regularly test, access, and evaluate the effectiveness of our security measures.

About Evolutix’s Cookie Policy

Evolutix uses cookies and similar technologies that collect and store information when you visit an Evolutix website.

This is done to allow Evolutix to identify your internet browser and collect data about website usage, which pages are visited, the duration of visits, and identify them when you return, so that we can improve the experience when visiting our websites. You can control and adjust your cookie preferences by adjusting your browser settings. On the Retention of Data at Evolutix

Personal data processed by Evolutix, according to this Privacy Policy, will be deleted or anonymized (so that it is no longer possible to identify it), either upon request of the data subject to Evolutix or within 05 (five) years for all subscription services after our last interaction with you, except for deadlines established by Law, such as labor origin data, financial transactions, etc.

Regarding financial transactions, personal data will be kept for 10 (ten) years from the moment of the transaction.

In all cases, information may be retained for a) a longer period of time, where there is a legal or regulatory reason to do so (and in this case it will be deleted once it is no longer necessary for the legal or regulatory purpose) or b) a shorter period, when the individual disapproves the processing of their personal data and there is no longer a legitimate purpose to retain them.

Evolutix undertakes, throughout the period indicated in this policy, that the data and/or project deposited by the user will be kept confidential.

On the Application of the Privacy Policy on Evolutix’s Social Media

If you choose to interact with Evolutix services, such as on the website, applications, or content through social networks such as LinkedIn, Facebook, WhatsApp, Instagram, and/or Twitter, your personal data (such as your name and the fact that you are interested in Evolutix news and/or events) will also be visible to all visitors of your personal internet page on LinkedIn, Instagram, Facebook, WhatsApp, and/or Twitter, according to your privacy settings on social media services.

Evolutix is not responsible and will not be responsible for the processing of such personal data or for the privacy policy of such social media sites.

When communicating with Evolutix through its social networks (for example, when posting a comment, uploading media, sending a personal message, or becoming our fan by clicking the “Like” button), we may receive personal data about you (such as your name or username, profile picture, place of birth, email address, and gender). We will use the data received from social networks in accordance with this Privacy Policy.

On the Validity and Modification of the Privacy Policy

This Privacy Policy may be changed over time.

Evolutix recommends everyone to regularly review the Privacy Policy for possible changes, but if they are significant, we will provide you with appropriate notice, including email notification if necessary.
